This Privacy Policy describes the practices of Acryl Data, Inc. d/b/a DataHub (“DataHub,” “us,” or “we”) concerning the collection, use, and disclosure of personal information through our websites datahub.com, docs.datahub.com, acryl.io, and acryldata.io (the “Site”). 

Applicability of this Privacy Policy

As indicated above, this Privacy Policy applies to personal information collected through our Site. This Privacy Policy does not apply to third-party services, websites, or applications that we may link to through the Site. When you use one of these links to leave our Site, we encourage you to review the privacy policies that apply to the services, websites, or applications you choose to access.

If you are a customer who has paid us for a plan, this Privacy Policy does not apply to your use of our services. Our privacy and data security obligations to you are outlined in the additional terms and conditions we have with you. How We Collect and Use Information

DataHub collects the following information from you through the Site:

  • Personal Information.
    • What we collect:  You may use and access the Site without providing us with any personal information. However, we may invite you to voluntarily submit certain personal information, such as your name, physical address, email address, and phone number. You may be asked to provide other optional information, such as general information about the data you collect, your company size, and other qualitative questions about your company. 
    • How we use it:  We will use personal information you provide (i) for the purposes described to you in this Privacy Policy or at the time you provided us with the information; (ii) to respond to your inquiries; (iii) to evaluate a prospective business opportunity with you; (iv) to send you newsletters, publications, and other communications that may be of interest to you; (v) for internal business analytics, such as understanding the demographics of visitors to our Site; and (vi) other uses consistent with applicable law.
  • Usage Information.
    • What we collect:  We may also automatically collect certain information regarding your access to and usage of the Site (“Usage Information”). We collect such information through the device you use to access and use the Site. We also collect Usage Information using first and third-party cookies and other tracking technology (collectively, “Tracking Technologies”). Usage Information includes, but is not limited to, your device type, operating system, browser type, IP address, MAC address, information about the websites or application from which you navigated to our Site, the information you input into our Site (such as search terms in the search bar), pages you access on our Site, how long you spend on a particular page on our Site, any links you click on, heatmaps and session replay recordings of your interactions with our pages as described under “Tracking Technologies” below, and similar information. If you interact with our website chatbot, we also collect your interaction data and text in accordance with this Privacy Policy.
    • How we use it:  We use Usage Information (i) to improve and customize the Site for users like you; (ii) to examine the effectiveness and response of visitors to information and content we put on our Site; (iii) for business analytics purposes, such as determining usage patterns on certain pages or features on our Site; (iv) for security and maintenance purposes; (v) for Tracking Technologies as described below; and (vi) other uses consistent with applicable law.
  • Compliance. In addition to the purposes of use we have described above, we also use personal information to comply with our legal obligations, or, when it is our legitimate business interests, we may use personal information to:
    • Comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities.
    • Protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims).
    • Audit our internal processes for compliance with legal and contractual requirements and internal policies.
    • Enforce our terms and conditions.
    • Prevent, identify, investigate and deter fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft.

Aggregate Information

We may use the information we collect to create “Aggregate Information”, which is aggregated and anonymized information, in order to develop statistics and analytics about our Site. We may use this Aggregate Information and share it with third parties for our lawful business purposes, including to analyze and improve our Site and promote our business.

How We Share Information With Third Parties

● Service providers. We may share your personal information with third party companies and individuals that provide services on our behalf or help us operate our Site and services (such as lawyers, bankers, auditors, insurers, and providers that assist with hosting, customer relationship management (CRM), communications, analytics, email delivery, marketing, and  general database management).

● Authorities and others. We may disclose your personal information to law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for the compliance and protection purposes described above.

● Business transfers. We may sell, transfer or otherwise share some or all of our business or assets, including your personal information, in connection with a business transaction (or potential business transaction) such as a corporate divestiture, merger, consolidation, acquisition, reorganization or sale of assets, or in the event of bankruptcy or dissolution. In such a case, we will make reasonable efforts to require the recipient to honor this Privacy Policy.

Information Security 

DataHub uses industry-standard technical and organizational safeguards to protect the information we collect through the Site. However, we cannot guarantee the absolute security of our Site or systems, and we, therefore, do not warrant that our safeguards will prevent the loss, theft, and unauthorized access, disclosure, alteration, misuse, or destruction of the information we collect. If we learn of any incident that may compromise the privacy or security of information we collect, we may notify you or others (including law enforcement or governmental authorities) consistent with applicable law. If you provided us with your email address, you agree that we may communicate with you electronically regarding the privacy and security of the information we collect.

Data Retention

We may retain your personal information for as long as it is reasonably needed to maintain and expand our relationship with you; in order to comply with our legal and contractual obligations; or to protect ourselves from any potential disputes. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of such information, the potential risk of harm from unauthorized use or disclosure of such information, the purposes for which we process it, and the applicable legal requirements.

Managing Your Information

As mentioned above, you do not need to provide any personal information to us to use the Site. Depending on your location, nature of interaction with our Site, and if you have provided us with personal information, you may contact us at notices@acryl.io if you wish, with respect to any personal information we have about you, (i) to view or obtain a copy of that information; (ii) to correct that information; (iii) to request deletion of some or all of the information; or (iv) to request a restriction of how we use the information, or to object to certain uses of the information.

Please note that, prior to any response to the exercise of such rights, we may require you to verify your identity. Depending on where you reside, you may be entitled to empower an “authorized agent” to submit requests on your behalf. We will require authorized agents to confirm their identity and authority, in accordance with applicable laws. You are entitled to exercise the rights described above free from discrimination. In addition, we may have valid legal reasons to refuse your request, and will inform you if that is the case.

Tracking Technologies

We use a range of Tracking Technologies to support our business. These may include:

  • Cookies are text files that websites store on a visitor’s device to uniquely identify the visitor’s browser or to store information or settings in the browser for the purpose of helping you navigate between pages efficiently, remembering your preferences, enabling functionality, engaging in advertising, and helping us understand activity and patterns.
  • Local storage technologies, like HTML5, provide cookie-equivalent functionality but can store larger amounts of data, including on your device outside of your browser in connection with specific applications.
  • Web beacons, also known as pixel tags or clear GIFs, are used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked.

We may use both persistent cookies and session cookies. Persistent cookies stay on your device for a set period of time or until you delete them, while session cookies are deleted once you close your web browser. The cookies placed through your use of our website are either set by us (first-party cookies) or by a third party at our request (third-party cookies).

Analytics and Session Replay

We use Google Analytics and Microsoft Clarity to understand how visitors engage with the Site. Microsoft Clarity captures how you use and interact with the Site through behavioral metrics, heatmaps, and session replay — a reconstructed recording of your clicks, scrolls, mouse movement, and navigation through our pages. We use this information for site optimization, to measure the performance of our content, and for security and fraud prevention purposes. This data is captured using first- and third-party cookies and other Tracking Technologies. We have configured Clarity to mask content entered into form fields and other content that may contain personal information. You can opt out of Google Analytics by downloading and installing the browser plug-in available at https://tools.google.com/dlpage/gaoptout.

If you prefer not to accept cookies or wish to disable the use of Tracking Technologies, most browsers and mobile devices allow you to change your settings so as to notify you when you receive cookies or other Tracking Technologies are being used and to choose whether or not to accept/allow them. Most browsers also allow you to disable or delete existing cookies or to reject future cookies automatically. Please note that disabling cookies may impair your use of the Site.

For more information about cookies, including how to see what cookies have been set on your device and how to manage and delete them, visit www.allaboutcookies.org.  You can block our Site from setting cookies used for interest-based ads by using a browser with privacy features or installing browser plugins like Privacy Badger, DuckDuckGo, Ghostery or uBlock Origin, and configuring them to block third party cookies/trackers.

Note that because these opt-out mechanisms are specific to the device or browser on which they are exercised, you will need to opt-out on every browser and device that you use.

Finally, some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit. We currently do not respond to “Do Not Track” or similar signals. To find out more about “Do Not Track,” please visit http://www.allaboutdnt.com.

Children

We do not collect personal information from children and we do not market our Site or services to children. We define “children” as anyone under 18 years old. If we learn we have collected or received personal information from a child without verification of parental consent, we will delete the information. If you believe we might have any information from or about a child, please contact us via the contact information noted below.

Job applicants

When you apply for one of our open positions, we collect the information that you provide in connection with your job application. This includes but is not limited to business and personal contact information, professional credentials and skills, educational and work history, and other information that may be included in a resume or that you may provide during the interview process. This may also include demographic or diversity information that you voluntarily provide. We may also conduct background checks and receive related information. We also collect personal information from other sources where relevant for your application, such as employment research firms, recruiters, identity verification services, and information that you make publicly available on websites or social media platforms (for example, LinkedIn). 

Throughout the recruitment process, we may supplement your personal information in connection with the assessment of your application. For example, we may record the views of those considering your application about your suitability for the role for which you have applied and retain interview notes. If you accept an offer from us, your personal information will be incorporated into and used as part of your employee record.

We use applicants’ information to facilitate our recruitment activities, process employment applications and personalize candidate communication, including evaluating candidates and monitoring recruitment statistics. We also use successful applicants’ information to administer the employment relationship. We may also use and disclose applicants’ information as otherwise described in this Privacy Policy and for the compliance and protection purposes described above.

U.S. State Privacy Rights

This section applies to residents of U.S. states with comprehensive consumer privacy laws, including California, Colorado, Connecticut, Delaware, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Texas, and Virginia. Not every right described below is available in every state. This section supplements the rest of this Privacy Policy and applies only to personal information we collect through the Site.

This section does not apply to personal information that we process on behalf of our customers under a written agreement, where we act as a service provider or processor. If you are an employee or end user of one of our customers, please direct your request to that customer.

Categories of personal information we collect

In the preceding 12 months, we have collected the following categories of personal information:

  • Identifiers. Name, email address, postal address, telephone number, IP address, and unique online or device identifiers.
  • Customer records. Contact details and employment information you choose to provide.
  • Protected classifications. Demographic or diversity information that job applicants voluntarily provide.
  • Commercial information. Records of products or services you have inquired about or considered.
  • Internet or other electronic network activity. The Usage Information described above, including pages viewed, links clicked, search terms entered, chatbot interactions, heatmaps, and session replay recordings.
  • Geolocation data. Approximate location inferred from your IP address. We do not collect precise geolocation.
  • Professional, employment, and education information. Provided by job applicants in connection with an application.
  • Inferences. Drawn from the above, such as an inferred interest in our products or services.
  • Sources. We collect this information directly from you, automatically from your device through Tracking Technologies, from our service providers, and — for job applicants — from recruiters, employment research firms, background check providers, and publicly available sources such as professional networking sites.
  • Purposes. We collect and use this information for the business and commercial purposes described under “How We Collect and Use Information” above, including the compliance and protection purposes described in that section.
  • Disclosures. In the preceding 12 months, we have disclosed each of the categories above for a business purpose to the categories of recipients described under “How We Share Information With Third Parties” above, including service providers, analytics providers, professional advisors, and government authorities or private parties where permitted or required by law.
  • Retention. We retain personal information according to the criteria described under “Data Retention” above.

Sensitive personal information

We do not collect sensitive personal information for the purpose of inferring characteristics about you, and we do not use or disclose sensitive personal information for purposes that would entitle you to limit that use under California law.

Sale of personal information, sharing, and targeted advertising

We do not sell your personal information for money. We do not share your personal information for cross-context behavioral advertising, and we do not process it for targeted advertising or for profiling in furtherance of decisions that produce legal or similarly significant effects concerning you. We have not done so in the preceding 12 months. We do not knowingly sell or share the personal information of consumers under 16 years of age.

Your rights

Subject to your state of residence and to applicable exceptions, you may have the right to:

  • Confirm whether we process your personal information and access that information.
  • Obtain a copy of your personal information in a portable format.
  • Correct inaccurate personal information.
  • Request deletion of your personal information.
  • Opt out of the sale or sharing of your personal information, of targeted advertising, and of certain profiling.
  • Limit our use and disclosure of sensitive personal information.
  • Obtain information about the categories of personal information we collect, use, disclose, and retain.
  • Not receive discriminatory treatment for exercising any of these rights.
  • Appeal a decision we make in response to your request, where your state provides that right.

How to exercise your rights

You may submit a request by emailing us at notices@acryl.io. Please tell us which right you wish to exercise and provide enough information for us to locate your records.

We will verify your identity before responding, and we may ask for additional information for that purpose. We will not use information you provide for verification for any other purpose. You may use an authorized agent to submit a request on your behalf; we will require the agent to provide proof of your written permission and will ask you to verify your own identity directly with us.

We will respond to your request within the time period required by your state’s law, generally within 45 days of receipt, and we may extend that period where permitted by providing you notice. We may decline a request where an exception applies, and we will tell you if that is the case.

If we decline your request and your state provides a right of appeal, you may appeal by replying to our response or by emailing notices@acryl.io with the subject line “Privacy Request Appeal.” We will respond to your appeal within 60 days. If we deny your appeal, you may contact your state attorney general.

Opt-out preference signals

Some browsers and extensions can send an opt-out preference signal, such as Global Privacy Control, indicating that you wish to opt out of the sale or sharing of your personal information and of targeted advertising. We treat a signal we detect as a valid request for the browser or device on which it is sent.

California “Shine the Light”

California residents may request information about our disclosure of personal information to third parties for those third parties’ own direct marketing purposes. You may submit such a request to notices@acryl.io.

Visitors Outside the United States

DataHub is established in the United States. When your data is transferred to us it will be processed in the United States and in any countries where our service providers operate their businesses. Such countries may not provide the same protections as the data protection laws where you are based. When we transfer data to these recipients, we do this on the basis of this policy, and we will ensure that relevant safeguards are in place to afford adequate protection for your personal information, and we will comply with applicable data protection laws. For example, if you are in the EEA, Switzerland, or the UK we rely on a government adequacy regulation or adequacy decision by a competent authority, on contractual protections for the transfer of your personal information, or a derogation if available. We also take care to work with subcontractors and service providers who we believe maintain an acceptable standard of data security compliance.

Updates to this Privacy Policy

We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on the website.
